Legal Issues of Home Based Online Businesses

Home based internet businesses have to comply with the same legal regulations as any legal internet business from any other location.

The first issue and a real concern for most home based internet businesses is the age-based restriction. The Federal Trade Commission of the United States follows the COPPA regulations. COPPA stands for Children’s Online Privacy Protection Act. This law requires that children who are under 13 years of age cannot disclose their personal information without their parent’s consent. In addition to this, individuals under the age of 18 cannot be allowed to enter any contract, nor allowed to view adult content on the internet. Home based online business owners must also make real their ownership of all content and property on their internet business website by having a copyright notice on the website’s footer. To do this, a real copy of the home based online business website must be filed with the U.S. copyright office. The copyright notice must contain the owner’s name, the date and the statement “All rights reserved”.

Real time occurrences on the internet such as chats and bulletin boards must be controlled by the home based online business owner. Forum discussions, postings, chats, and message boards should have rules where the consent of each online user is solicited and retained with regard to refraining from posting defamatory materials, pornography or anything that may infringe other people’s rights.
